1. About these terms
These Terms of Service ("Terms") govern your access to and use of thepilotexam.com and the associated iOS and Android applications (together, the "Service"), operated by thepilotexam.com ("we", "us", "our"), based in Brisbane, QLD 4000, Australia. By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service. By using the Service you represent that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
3. Accounts
- You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
- You must provide accurate information when registering and keep it up to date.
- We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
4. Credits and payments
- Certain features require the purchase of credits. Credits are denominated in Australian dollars (AUD) and are processed securely by Stripe.
- Credits do not expire and are non-transferable between accounts.
- All purchases are final. We do not offer refunds except where required by Australian Consumer Law (ACL).
- We reserve the right to change credit prices at any time. Price changes will not affect credits you have already purchased.
5. Acceptable use
When using the Service you must not:
- Reproduce, redistribute, or resell any content from the Service without our written permission.
- Use automated tools (bots, scrapers, etc.) to access or extract content from the Service.
- Attempt to reverse-engineer, circumvent, or interfere with any part of the Service.
- Use the Service for any unlawful purpose or in breach of any applicable law or regulation.
- Share your account credentials with others or allow third parties to access the Service through your account.
6. Intellectual property
All content on the Service — including questions, explanations, charts, diagrams, software, and branding — is owned by or licensed to us. Nothing in these Terms transfers any intellectual property rights to you. You may use the Service solely for your personal, non-commercial study purposes.
7. Educational purpose disclaimer
The Service is designed to assist with Australian pilot theory exam preparation only. It is not a substitute for officially approved flight training, certified ground school instruction, or any other requirement mandated by the Civil Aviation Safety Authority (CASA). Passing a practice exam on this platform does not guarantee a pass on any official CASA examination. We make no representations regarding the completeness or currency of the question bank relative to the current CASA syllabus.
8. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, or uninterrupted availability.
- We are not liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the Service.
- Our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes any right or guarantee you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Service availability
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend, modify, or discontinue any part of the Service at any time, with or without notice, for maintenance, updates, or other operational reasons.
10. Third-party links and services
The Service may contain links to third-party websites or integrate third-party services (such as Clerk for authentication and Stripe for payments). We are not responsible for the content or practices of any third party. Use of third-party services is governed by their respective terms and policies.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
